TO BE AUCTIONED AT COURT’S ORDER OF SINT MAARTEN

The title and rights to the following immovable property :

A parcel of land having an area of TWO THOUSAND FIVE HUNDRED TWENTY-NINE SQUARE METERS (2529m²), situated on the island of Sint Maarten at Oyster Pond, locally known as Dawn Beach Estate Lot 69, in the district of Upper Princes Quarter and described in certificate of admeasurement number SXM UPQ 381/1990, with all appurtenances belonging thereto, hereinafter referred to as “property 1".

Reserve price for property 1 (being the minimum bid) will be ONE HUNDRED NINETY EIGHT THOUSAND AND NINE HUNDRED DOLLARS CURRENCY OF THE UNITED STATES OF AMERICA (US$.198,900.00).

Private bids (NOT possible during this auction) are offers in writing which can be made for purchasing properties auctioned ex article 3:268 paragraph 2 of the Civil Code.

Seller has the right to change the Reserve Price prior to the auction and to postpone or stop the auction at any time. The sale will take place under the customary auction conditions which are, by raised bid (in Dutch: “middels opbod”) and subsequently by decreasing or Dutch bid (in Dutch: “bij afmijning”) in one (1) session. Seller has the right to not accept any bid, at its sole discretion.

The general as well if any special conditions on the auction, will be available at Notary office Mingo situated at the Fouress Building Suite 4D, Emmaplein, Philipsburg.

Every bidder or potential buyer has to identify him or herself with a valid passport or local identification card. Bidders on behalf of legal entities have to provide the notary on the day of the public auction with a recent original extract of the Commercial Register issued by the Chamber of Commerce (not older than three (3) days) and updated articles of association. Every bidder or potential buyer has to provide the civil law notary with a written guarantee by a banking institution recognized by the Central Bank of Curacao and Sint Maarten (for example a bank letter/or banker’s check) for the payment of his or her bid and the additional and affiliated auction charges which are for the buyer (as stipulated in the general auction conditions of civil law notary Mingo).

Interested parties are strongly advised/recommended to:

  • (i) to review the auction conditions before attending the auction;
  • (ii) to start requesting their bank guarantee at least four (4) weeks prior to the auction, come with a banker’s check or have the funds (being the amount of the bid the buyer wishes to place) deposited into the escrow account of the notary.
